[Checks Received] Chipotle GMO Class Action Settlement

The lawsuit claims that Chipotle’s “non-GMO” advertising located in its restaurants was misleading and deceptive to consumers. Chipotle has denied any wrong doing but has agreed to a settlement.

Who’s Eligible?

Eligible consumers are:

  • All persons in the United States who purchased Chipotle’s Food Products in its restaurants during the Class Period (April 27, 2015 to June 30, 2016 inclusive)

You’re able to file five claims without proof of purchase and ten claims with proof of purchase. There is a limit of 15 valid claims per household.

How Much Will You Receive?

Chipotle has agreed to pay $6,500,000 into a non-reversionary Fund in full and complete settlement and release of all claims of Plaintiffs and the Settlement Class Members, as described in the Settlement. The amount you receive is capped at $2 per claim and will be pro rata decreased base on how many claims are submitted.

Our Verdict

Look there is a zero percent chance you’re going to get $2 per claim. The $6,500,000 settlement pool is before attorney fees & costs (they’ve asked for 30% of the settlement pool + costs) and then each class representative is getting $5,000. I suspect you’ll be lucky to get $0.1 per claim if I’m being brutally honest. Still if you don’t participate it’s high unlikely you’re going to sue Chipotle individually anyway so might as well go for it and hope for the best.
