Kia Vehicle Theft Class Action Lawsuit

- The lawsuit seeks damages for cars that were improperly manufactured with a series of design flaws that make them susceptible to theft and damage. If you purchased or leased one of the Kia vehicles below and it was not equipped with an engine immobilizer, you might benefit from a class action settlement.
Who Is Eligible
The Settlement includes: all persons or entities who purchased or leased a Class Vehicle in the United States (including Puerto Rico, U.S. Virgin Islands, and Guam).
- If I purchased or leased a Class Vehicle that has not been stolen or damaged, am I included?
Yes, you did not have to experience a theft or attempted theft to be included in this Settlement. If you purchased or leased certain Class Vehicles, you are eligible to take advantage of the free Software Upgrade. You may also file a Claim for reimbursement for lost income or childcare expenses for the time spent getting the Software Upgrade, as well as reimbursement for the purchase of key fobs, if key fobs were purchased at the direction of Kia dealers as required for the implementation of the Software Upgrade. You may also file a Claim for reimbursement for the purchase of a steering wheel lock or equivalent device if that purchase was made at least thirty days before the Software Upgrade was available for your Class Vehicle. - If you owned or leased a Class Vehicle that is not eligible for the Software Upgrade, you may file a Claim for reimbursement for purchase and/or installation of a steering wheel lock, glass breakage alarm or similar anti-theft system, or another aftermarket modification designed to deter or prevent theft. Class Members that owned or leased a Class Vehicle that is not eligible for the Software Upgrade that already received a steering wheel lock from Kia (for example, from a dealership or through law enforcement) are eligible for reimbursement for purchase and installation of a glass breakage alarm or similar anti-theft system, or another aftermarket modification designed to deter or prevent theft.
How Much
- Reimbursement of 60% of Black Book value of the Class Vehicle for the Total Loss of a Class Vehicle due to a Qualifying Theft or Qualifying Theft Attempt.
- Reimbursement of $3,375 or 33% of Black Book value of the Class Vehicle (whichever is greater) for Damage to a Class Vehicle and/or Damaged or Lost Personal Property due to a Qualifying Theft or Qualifying Theft Attempt.
- Reimbursement up to $375 for an Insurance Deductible Paid and/or an Increased Insurance Premium due to a Qualifying Theft or Qualifying Theft Attempt.
- Reimbursement up to $250 for other Out-of-Pocket Expenses due to a Qualifying Theft or Qualifying Theft Attempt.
- Reimbursement up to $250 for Lost Income and/or Childcare Costs in Obtaining the Software Upgrade for a Class Vehicle. NOTE: This is a benefit available only for Class Vehicles that had the Software Upgrade installed.
- Reimbursement Available for Class Vehicles Eligible for the Software Upgrade:
- Reimbursement for a Key Fob Purchase made to receive the Software Upgrade (up to $350 per key fob, limit of 2 per Class Vehicle, if it was purchased at direction of a Hyundai dealership for the installation of the Software Upgrade).
- Reimbursement up to $50 for the Qualifying Purchase of a Steering Wheel Lock for a Class Vehicle, which was made at least thirty (30) days before the Software Upgrade was available for the Class Vehicle.
- Reimbursement Available for Class Vehicles NOT Eligible for the Software Upgrade:
- Reimbursement up to $300 for the Qualifying Purchase of a Steering Wheel Lock and/or a Glass Breakage Alarm or Similar Anti-Theft System or Another Aftermarket Modification Designed to Deter or Prevent Theft for a Class Vehicle.

Our Verdict
Most Kia owners already know that they can get the fix from a Kia dealership to take care of the security flaw. This lawsuit will reimburse others kinds of expenses as well – I know people who incurred costs due to the Kia issues, such as broken windshields and steering wheel lock purchases. Not clear to me how someone knows if their insurance was higher due to the Kia security flaw. I also found interesting the reimbursement of “up to $250 for Lost Income and/or Childcare Costs” while getting the fix at the dealership.
I think it’s unfair that vehicles with push button start are excluded. Sure, the Kia Boyz can’t steal your car, but they would wreck it in the attempt. Morel likely than not, insurance companies raise premium across the board for all Kia/Huyndai cars, not just the ones without immobilizer. Not to mention the hit to resale values.
The only cost I incurred was a spike in my insurance premium. I also bought a dash cam. At time of software update, dealership never said I should get a second key-fob… car only came with one…

So, this class action lawsuit is really about how the USA is a crime-ridden country rather than an anti-theft system that’s good enough in most OECD countries. I don’t think Americans should be proud of this lawsuit.
I don’t think Americans should be proud of a crappy corporation that is too cheap to put in a decent anti-theft system in their overpriced cars. You do realize that Kia’s are targeted because their anti-theft system is basically non-existent? They save money and you get screwed. I don’t think you should be proud of your post.

This is the legal equivalent of “If she didn’t want to be sexually harassed she should not have dressed like that”. Cannot believe we live in times with this level of stupidity.

Not really a good comparison, they aren’t blaming the victims (anyways the victims are the car owners rather than kia) just establishing that consumers have a reasonable expectation that a car not be trivially easy to steal. The criminals are still the criminals here, this is a civil case
When are we gonna go after Samsung and LG for their POS refrigerators and washing/drying machines? My Samsung fridge compressor went kaput last week after 6 years. The cost of time and labor to diagnose + replace the compressor through the Samsung 10-year digital inverter compressor “warranty” process and to “fix” it again 6 years later is not worth the cost when I can just buy a new refrigerator. Kimchi is now off the menu b/c it’s now rotting in my broken fridge. RIP.
The worst thing these Korean firms have done is price out the competition so that it becomes harder to buy nicer German/Japanese products in the same category. In many cases it’s not possible anymore.
Samsung appliances have such a bad reputation for reliability, yet people still buy them because marketing. LG is not as bad, but it’s so upsetting that all the marketing and media from Korea has people convinced they make good stuff when the quality just isn’t there.
Hyundai/Kia have come a long way, especially stealing a bunch of German automotive designers. But they will never be Toyota/Honda reliable.
I thought Samsung refrigerators were good, at least the most recent ones like the Bespoke models, and that LG washers/dryers were the best in the business (Consumer Reports ranked LG #1).
the only decent things that samsung and lg make are cell phones, computing displays & hard drives. but it doesn’t matter in a world where my ipotato6 and 2012 macbook still werk. in any case, all korean major appliances & vehicles are crap. look nice, yes, but its still a pig zerg wearing a dress and lipstick behind the marketing machine just like all their post-op kpop idols. and consumer “reports” are all lies and pay to play. toyota and honda need to pivot and make refrigerators. make refrigeration great again!!!

I mean, my insurers have been clear that my insurance is higher on a Hyundai even though its model was never affected (and never could have been, it was always push button start).

No Hyundai settlement? Just Kia?
